Legal
Terms of service
Effective date: November 4, 2026
Last updated: November 4, 2026
These Terms of Service ("Terms") are a legal agreement between you and TREKA LLC, a Washington limited liability company doing business as Stoke ("Stoke," "we," "us," or "our"), governing your use of the Stoke website at stokeday.com, the Stoke web and mobile applications, our emails, text messages, and any related services (together, the "Service").
Please read these Terms carefully. They include a mandatory arbitration provision and class action waiver (Section 16), a release of liability for outdoor activities (Section 7), and automatic renewal terms for paid plans (Section 5). By creating an account, joining the waitlist, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use Stoke
You must be at least 18 years old to create an account or subscribe. If you are between 13 and 17, you may use the free parts of the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.
By using the Service, you represent that you have the legal capacity to enter into these Terms and that you are not barred from using the Service under any applicable law.
2. What Stoke is, and what it is not
Stoke provides estimates and opinions about outdoor conditions. The Service combines third-party data (such as weather forecasts, snowpack sensors, road status, and river gauges) with our own models and user-submitted reports to produce scores, recommendations, alerts, and written summaries, some of which are generated with artificial intelligence.
Stoke is an informational and planning tool only. It is not a safety service, an emergency service, a weather service, a guide, an avalanche forecast, or a substitute for your own judgment. Specifically:
- All scores, picks, "Stoke meter" values, verdicts, alerts, trip plans, and summaries are estimates. They can be wrong, late, incomplete, or based on inaccurate or outdated third-party data.
- Stoke does not assess avalanche danger, water hazards, rockfall, weather emergencies, trail closures, or any other hazard. Always consult official sources, including the Utah Avalanche Center, the National Weather Service, land managers, resorts, and local authorities, before you go.
- Stoke does not verify road, parking, lift, resort, or permit status. Conditions change quickly and without notice.
- Content generated by artificial intelligence may contain errors. We attempt to base written content on verified data, but we do not guarantee it.
- Crowd and wait-time information, where offered, is an estimate based on models and aggregated signals and is not a measurement.
You are solely responsible for your own safety and for every decision to travel, ski, ride, climb, fish, paddle, hike, or otherwise participate in any activity.
3. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at support@stokeday.com if you believe your account has been accessed without permission. You may not share an account, use another person's account, or create accounts by automated means. We may suspend or close accounts that violate these Terms.
4. Free and paid plans
Stoke offers a free plan and paid plans (for example, "Stoke Pro" and, where available, a "Crew" plan). Features of each plan are described on the Service and may change over time. We may add, modify, or remove features of any plan, including the free plan, at any time. We will not reduce the core features of a paid plan you have already paid for during your current billing period without offering you a pro-rated refund for the remainder of that period.
5. Payment, automatic renewal, and cancellation
Billing. Stoke Pro is offered as a yearly plan, at the prices shown on the checkout page (currently $29.99 a year for Pro, $79.99 a year for a Crew plan covering up to four people, and $14.99 a year for Pro members who have earned the referral price). We no longer sell a monthly plan. If you subscribed to a monthly plan before November 4, 2026, your plan moves to the yearly Pro plan at the end of a monthly period you have paid for, and we will email you before that happens; you may cancel before the change takes effect. If you subscribed to a yearly plan at an earlier, higher price, your next renewal is charged at the current lower price. Paid plans are billed in advance for the full plan period. Payments are processed by Stripe; we do not store your full card number. You authorize us and our payment processor to charge your payment method for the plan you choose, applicable taxes, and any future renewals.
Automatic renewal. Paid plans renew automatically at the end of each plan period at the then-current price for your plan, unless you cancel before the renewal date. We will send a reminder to the email on your account about 7 days before each yearly renewal. The price you were quoted at signup is stated on the checkout page and in your receipt.
Referral price. When three different people create a Stoke account through your referral link and confirm their email, you earn the referral price for the Pro plan ($14.99 a year). If you subscribe after earning it, you pay $14.99 a year for each renewal for as long as your subscription stays continuously active. If you already pay for Pro when you earn it, your plan moves to the referral price with no charge at that time, and your next renewal and each one after are $14.99. If you still have an earlier monthly plan, you may choose to switch to the referral price; your monthly period runs out first and you are then billed $14.99 a year. The referral price applies to the Pro plan only (not Crew plans), is personal to you, cannot be transferred, and ends if your account is terminated for a violation of these Terms.
Free trials and promotions. A free trial or promotional period converts to a paid subscription at the end of the trial unless you cancel before it ends. We will state the trial length and the price that applies afterward before you start.
Cancellation. You may cancel at any time through your account settings or the billing portal. Cancellation stops future renewals. Except where required by law, fees are non-refundable, and you will keep access to paid features until the end of the period you already paid for. If you cancel within 14 days of your first purchase of a plan, we will refund that first payment on request; this does not apply to renewals.
Price changes. We may change plan prices. For a price increase to a plan you are subscribed to, we will notify you at least 30 days before it takes effect, and the new price applies at your next renewal unless you cancel. The referral price is not subject to increases while your subscription stays continuously active, as described above.
Crew plans. A Crew plan covers the person who buys it (the "owner") and up to three other people the owner invites by link or email (the "members"). Each member needs their own Stoke account. Members get Pro features only while they are in the crew and the owner's Crew subscription is active; if the owner cancels, the subscription ends, or a payment fails and the subscription lapses, members lose Pro at the same time as the owner. The owner can remove members at any time from Settings, which ends their Pro right away and frees their spot; members can leave at any time. Joining a crew does not cancel a member's own Pro subscription; a member who no longer needs it must cancel it themselves, and it is not refunded because they joined a crew. Only the owner is billed and only the owner can cancel or change the Crew plan. The owner can see the names and emails of the people in their crew, and members can see who else is in it.
Taxes. Prices may exclude taxes. You are responsible for any taxes that apply.
6. Alerts, email, and text messages
Email. By creating an account or joining the waitlist you agree to receive transactional and service emails (for example, confirmations, receipts, security notices, and alerts you configure). You may also receive marketing and informational emails, such as the weekly picks email; you can unsubscribe from those at any time using the link in each email. Unsubscribing from marketing does not stop transactional emails.
Text messages (SMS). Where offered, you may opt in to receive text message alerts from Stoke through our Stoke Alerts program (details and the opt-in form: stokeday.com/sms). By opting in, you consent to receive automated text messages from Stoke at the mobile number you provide, including condition alerts, account messages, and reminders. Consent is not a condition of purchase. Message frequency varies by your alert settings and conditions. Message and data rates may apply. Reply STOP to cancel at any time and HELP for help. You confirm you are the owner or authorized user of the number provided, and you will tell us if the number changes. Alert texts may include an image (MMS). We hold texts during quiet hours (9 PM to 6 AM local time) and send at most 3 alert texts a day. Carriers are not liable for delayed or undelivered messages. Help: reply HELP or email support@stokeday.com. Our SMS privacy practices are described in the Privacy Policy; no mobile information is shared with third parties or affiliates for marketing or promotional purposes.
Reliability. Alerts depend on third-party data, networks, and carriers. We do not guarantee that any alert will be sent, delivered, timely, or accurate, and you must not rely on alerts for safety.
7. Outdoor activities: assumption of risk and release
Outdoor activities, including but not limited to skiing, snowboarding, backcountry travel, climbing, mountain biking, hiking, trail running, fishing, surfing, and paddling, are inherently dangerous and can result in serious injury, death, or property damage. Risks include, without limitation, avalanches, changing weather, falls, collisions, equipment failure, altitude, cold, water hazards, wildlife, road conditions, and the actions of other people.
By using the Service, you acknowledge and agree that:
- You voluntarily assume all risks of any activity you undertake, whether or not you used the Service to plan it.
- Stoke does not control conditions, locations, resorts, roads, or your conduct, and has no duty to warn you of any hazard.
- To the fullest extent permitted by law, you release and discharge TREKA LLC and its members, managers, officers, employees, contractors, data providers, partners, and affiliates (the "Stoke Parties") from any and all claims, demands, losses, and liability, including for negligence, arising out of or related to any injury, death, or damage connected to your outdoor activities or your reliance on the Service.
- You will comply with all laws, resort rules, closures, permits, and land-manager requirements.
If you are a parent or guardian permitting a minor to use the free Service, you make these acknowledgments on the minor's behalf.
8. User content and check-ins
The Service may let you submit content such as condition ratings, check-ins, tags, photos, comments, crew messages, and predictions ("User Content"). You keep ownership of your User Content. You grant Stoke a worldwide, non-exclusive, royalty-free, perpetual, sublicensable license to use, host, store, reproduce, modify, aggregate, analyze, display, and distribute your User Content in connection with operating, improving, and promoting the Service, including to improve our models and to produce aggregated statistics. We may use aggregated or de-identified data derived from User Content for any purpose.
You are responsible for your User Content. You agree not to submit content that is false or misleading about conditions, that you do not have the right to share, that infringes anyone's rights, or that is unlawful, harassing, or harmful. We may remove User Content or disable accounts at our discretion.
9. Referral and crew programs
Refer a friend. When someone signs up through your referral link and buys Pro for the first time, their first month is free (a 30-day trial that converts to the plan they chose unless they cancel). After their first successful payment, you receive one free month of Pro: if you have an active paid subscription, your next renewal is moved back by one month; if you don't, you get one month of Pro at no charge. You can earn this free month once per account: later friends who go Pro with your link still get their own first month free, but don't earn you another month. When three friends create a Stoke account through your link and confirm their email, you earn the referral price described in section 5. Each person counts once, an account must be created through your link (not attached to it later), and you can't refer yourself.
Free year for paying referrals. For every five people who sign up through your referral link and become paying Pro subscribers, you receive one free year of Pro (a $29.99 value at the current Pro price). A referred person counts once, when their first successful payment for Pro goes through, and their free first month does not count as a payment. The fifth, tenth, fifteenth and each later multiple of five paying referrals each earn one year. If you have an active paid subscription, your next renewal is moved back by one year, so the free year starts after the period you have already paid for; if that would move your renewal more than two years out, we instead add a credit equal to one year of Pro at the current Pro price to your Stripe account balance, which is applied to your upcoming renewals. If you don't have a subscription, you get one year of Pro at no charge, added to any free time you already have. The free year is in addition to the free month and the referral price above. It has no cash value, is not refundable or transferable, and cannot be exchanged for money. Referrals must be real, different people who sign up and pay for themselves; we may withhold, delay, or reverse a free year for referrals we reasonably believe are self-referrals, duplicate or fake accounts, paid for by you or on your behalf, refunded, disputed, or otherwise abusive.
Referral rewards generally. We may offer rewards (such as free months, position changes on a waitlist, or badges) for referring others. Rewards are stated on the Service at the time, are not cash, have no cash value, are not transferable, and may be changed, capped, or ended at any time. A referral is credited only when it meets the conditions stated on the Service (for example, a confirmed email or a first successful payment), and may be reversed if the referred person refunds, disputes, or violates these Terms. We may withhold or revoke rewards for referrals we reasonably believe are self-referrals, fraudulent, automated, purchased, or otherwise abusive. Lifetime or "forever" rewards apply only while your account and any required subscription remain continuously active and in good standing, and only for the lifetime of the Service.
Waitlist. Waitlist position and referral rewards are allocated as described on the Service. Pricing does not depend on waitlist position. A waitlist position is not a guarantee of access or pricing until a purchase is completed.
Crew plans. The person who purchases a Crew plan is responsible for payment and for the conduct of members they invite. Members must each have their own account and agree to these Terms. Billing, membership, and how members lose Pro are described in section 5.
Prediction games. Any prediction or "call the weekend" style feature is a free game of skill offered for entertainment. No purchase is necessary, no money may be wagered, prizes have no cash value, and we may change or end the game at any time. Void where prohibited.
10. Acceptable use
You agree not to: (a) scrape, crawl, copy, or harvest data, scores, or content from the Service except through interfaces we expressly provide; (b) resell, redistribute, or publicly display Stoke scores, alerts, or data without our written permission; (c) use the Service to build a competing product or to train machine-learning models; (d) interfere with, overload, or circumvent the security of the Service; (e) impersonate anyone or misrepresent your affiliation; (f) submit false condition reports or manipulate referrals, leaderboards, or predictions; (g) use the Service for any unlawful purpose; or (h) access the Service by automated means other than publicly documented APIs we offer.
11. Intellectual property
The Service, including its software, design, scoring models, data compilations, text, graphics, logos, and trademarks (including "Stoke," the Stoke logo, and "Stoke meter"), is owned by TREKA LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. All other rights are reserved. Feedback you send us may be used without obligation to you.
12. Third-party data and services
The Service relies on data and services from third parties, including government agencies (such as the National Weather Service, NRCS SNOTEL, UDOT, USGS), resorts, map and routing providers, payment processors, email and SMS providers, and AI model providers. We do not control and are not responsible for the accuracy, availability, or terms of third-party data or services. Links to third-party sites, including lodging, gear, or booking sites (some of which may pay us a commission), are provided for convenience; your dealings with those sites are solely between you and them.
13. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms. If a change is material, we will notify you by email or a notice in the Service at least 14 days before it takes effect, except that changes required by law may take effect immediately. Your continued use after the effective date means you accept the updated Terms. If you do not agree, cancel and stop using the Service before the effective date.
14. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or for any other reason at our discretion. If we terminate a paid subscription without cause, we will refund the unused portion of the period you paid for. Sections that by their nature should survive termination (including Sections 2, 7, 8, 11, 15, 16, and 17) will survive.
15. Disclaimers and limitation of liability
DISCLAIMER. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE STOKE PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY SCORE, FORECAST, ALERT, RECOMMENDATION, OR AI-GENERATED CONTENT WILL BE ACCURATE OR THAT ANY CONDITION WILL EXIST.
LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE STOKE PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, OR FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM OUTDOOR ACTIVITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE STOKE PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
16. Dispute resolution: binding arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting any formal proceeding, you agree to email us at legal@stokeday.com with a description of the dispute and your contact information, and to try in good faith to resolve it with us for at least 45 days.
Binding arbitration. If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. The arbitrator will decide all issues, including the scope and enforceability of this section. Arbitration will take place in the county in Washington State where TREKA LLC has its principal place of business, or by video or written submission for claims under $10,000, at your election. We will pay AAA filing fees above $200 for claims under $10,000 unless the arbitrator finds the claim frivolous.
Class action waiver. You and Stoke agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class action waiver is found unenforceable as to a particular claim, that claim must be brought in court and not in arbitration.
Jury trial waiver. To the extent any claim proceeds in court rather than arbitration, you and Stoke each waive any right to a jury trial.
Opt-out. You may opt out of this arbitration agreement by emailing legal@stokeday.com within 30 days of first accepting these Terms, stating your name, the email on your account, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Time limit. Any claim must be filed within one year after it arises, or it is permanently barred, to the extent permitted by law.
17. Governing law and venue
These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 16, any court proceeding will be brought exclusively in the state or federal courts located in the county in Washington State where TREKA LLC has its principal place of business, and you consent to their jurisdiction.
18. Indemnification
You agree to defend, indemnify, and hold harmless the Stoke Parties from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms or any law, your outdoor activities, or your violation of any third party's rights.
19. General
These Terms, together with the Privacy Policy and any plan-specific or program-specific terms posted on the Service, are the entire agreement between you and Stoke about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to the email on your account. Nothing in these Terms creates any third-party beneficiary rights except for the Stoke Parties under Sections 7, 15, and 18.
